Welcome to the services of VV Retail Co., Ltd. (the “Company”). The provision of membership services through the website, including the use of services through the LINE platform, shall be subject to these Terms and Conditions.

Please read these Terms and Conditions carefully before using the services.

1. Definitions

  • Company means VV Retail Co., Ltd., including but not limited to its affiliated companies, unless the context of these Terms and Conditions provides otherwise. This shall also include employees, staff, directors, agents, representatives, advisors, and any other persons assigned by such legal entities.
  • Personal Data means any information relating to an individual that can directly or indirectly identify such individual, such as identification information, contact information, information relating to the Company’s products and services associated with you, and other similar information.
  • Notifications means customized notification message services that may appear from time to time in the form of text, images, and/or hyperlinks, sent through communication channels for which you have given consent to receive services, such as email, SMS, or LINE Application.
  • LINE Application or LINE means an online communication application that can be used through communication devices such as smartphones, tablets, or computers. LY Corporation is the main service provider and has authorized the Company to create a commercial communication channel on LINE under the name BetterVision Line Official Account, and to use various functions available on LINE for commercial communication purposes.
  • Services means the Company’s membership services.
  • System means the BetterVision Line Official Account, which is one of the communication channels between you and the Company under the license to use services provided by LINE Corporation through the LINE Application. The System includes automated chat response services, information on the Company’s products and services, general marketing and promotional information, as well as various programs to be provided to you, including notifications.

2. Acceptance of the Terms and Conditions

By accessing or connecting to the System, you acknowledge and agree to strictly comply with all provisions of these Terms and Conditions. These Terms and Conditions shall be deemed part of the agreement for the use of the System and shall be legally binding between the Company and you.

The Company reserves the right to suspend your use of the System at any time if it appears that you have violated or refused to comply with any part or all of these Terms and Conditions. This includes refusal to provide consent for the collection, use, disclosure, or transfer of data that is necessary and relevant to the use of the System, objection to such actions, or subsequent withdrawal of such consent.

You accept these Terms and Conditions and consent to the Company collecting, using, disclosing, and transferring your Personal Data in accordance with the Company’s scope and conditions. You acknowledge that you have read and understood all details, including your rights and any limitations stated in these Terms and Conditions.

3. Better Vision Membership System and Member Benefits

Membership Status and Membership Tiers

You are entitled to earn points from purchases made at the Company’s stores and may be upgraded to higher membership tiers based on your accumulated purchase amount and other conditions as specified by the Company.

Points and Expiration Date

Accumulated points are valid for no more than 2 years from the date the points are earned. Expired points will be deducted twice a year, on June 30 and December 31 of each year. Examples are as follows:

Points earned from January 1, 2023 to June 30, 2023 will expire on June 30, 2025.

Points earned from July 1, 2023 to December 31, 2023 will expire on December 31, 2025.

4. Your Responsibilities

  • You agree to provide accurate and truthful information to the Company for the purpose of using the System. In some cases, the Company may request additional documents to verify, update, or correct your information to ensure that such information is accurate, current, complete, and not misleading. You agree to comply with such requests without delay.
  • You agree to comply with all applicable laws and not to take any unlawful actions that may cause damage to the Company or any third party through the use of the Services and/or the System.

5. Personal Data Protection

The Company shall comply with the necessary procedures and processes in accordance with applicable laws regarding the collection, use, disclosure, and transfer of Personal Data provided by you to the Company, including the security protection of Personal Data.

Such Personal Data will be used for the Company’s operations in accordance with the purposes stated in these Terms and Conditions, or for other purposes within the scope permitted by law. You may review the details of the Company’s Personal Data processing here.

6. Amendments to the Terms and Conditions

The Company may change these Terms and Conditions, including the content and format of the Services, from time to time as the Company deems appropriate, without obtaining your consent. The Company will announce or notify you of such changes through the System, email, or other communication channels for which you have provided information to the Company.

Your continued use of the System after any changes to these Terms and Conditions shall be deemed your acknowledgment and acceptance of the amended Terms and Conditions.

Since the System may not provide separate notifications regarding amendments to these Terms and Conditions, please review these Terms and Conditions before using the System each time. If you do not wish to continue using the System under the new Terms and Conditions, you may cancel your use of the System by removing the System from your list in the LINE Application.

Removal of the System from your LINE Application list, or termination of use of the System by any other method, shall not affect the existence or validity of any legal obligations between the Company and you that arose prior to such action.

7. Violation of the Terms and Conditions

In the event of any violation of these Terms and Conditions, the Company reserves the right to suspend access to or terminate any services provided to you, whether in whole or in part.

Such suspension or termination shall not limit the Company’s right to remedies under these Terms and Conditions, including any other claims or rights available under applicable laws.

8. Linking the Membership System with LINE

  • If you link the membership system with LINE, the System will become part of and operate under LINE’s infrastructure and operating system, and will function through wireless networks or the internet. As a result, the Company may not be able to independently control or manage the basic operation of the System.
  • The use of the System may therefore be subject to errors, inaccuracies, or interruptions during certain periods of operation. The transmission of Personal Data through the System may also be incomplete, which is beyond the Company’s control.
  • Since your LINE account and password are important keys for accessing the System, please ensure the security of your information by keeping your account and password confidential. Do not share your LINE account or use of the System with others, and strictly comply with LINE’s Privacy Policy.
  • You are responsible for any actions that occur through your account and for any resulting consequences. If you lose control of your password, Personal Data, or any other information sent to the Company, you shall be legally responsible and bound by such actions. The Company reserves the right to disclaim liability for any actions arising from such circumstances.
  • Therefore, if you are unable to access the System using the original account registered in the System for any reason, you must immediately notify the Company to prevent unauthorized access to your information by other persons.
  • LINE’s policies, measures, and any changes to LINE or the internet system may affect these Terms and Conditions. The Company may also be subject to limitations in processing your Personal Data under any policies or measures of LINE and the internet system.
  • You acknowledge that the System may not be able to immediately display your latest information on LINE, and it may take approximately 3 days to update and display such latest information. In addition, if there is more than one set of your information, the System will display only your latest information.

9. Limitation of Liability

The Company shall not be liable for any damages arising from the provision of the Services, unless such damages are caused by the Company’s intentional act or gross negligence.

The Company shall only be liable for ordinary damages that normally arise and shall not be liable for loss of benefits or any other special damages.

10. Relationship Between Laws, Regulations, and These Terms and Conditions

If any provision of these Terms and Conditions violates any applicable law or regulation, such provision shall be deemed unenforceable against you, without affecting the validity of the remaining provisions of these Terms and Conditions.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by the laws of the Kingdom of Thailand. Any legal dispute or conflict that may arise shall be subject to the jurisdiction of the Thai courts.
